These Pay by Link Terms & Conditions (“Payment Terms”) govern the use of payment links generated through the nashi platform (“nashi”, “we”, “us”, or “our”) and presented to end-customers (“Shopper”, “you”).

By completing a payment via a nashi Pay by Link URL, you agree to these Payment Terms, in addition to any specific product, service, or store terms provided by the merchant requesting payment (“Merchant”).

1. Parties and Relationship (Merchant of Record)

1.1 Merchant Identification & Merchant of Record: The Merchant requesting payment—as identified on your payment invoice, order confirmation, or credit card statement—is the Merchant of Record (MoR) for your transaction. The Merchant is solely responsible for:

  • The sale, quality, safety, legality, and fulfillment of the goods or services purchased.

  • Setting the purchase price, taxes, shipping fees, and applicable terms of sale.

1.2 Platform & Technical Provider: nashi provides technical platform infrastructure and software tools to enable Merchants to generate and manage payment links. nashi is not the buyer or seller of the goods or services and is not a party to the underlying commercial contract between you and the Merchant.

1.3 Payment Processing: Payment processing services for Pay by Link transactions are provided by our authorized third-party payment service provider(s) operating through integrated platform payment infrastructure.

2. Payment Processing & Terms

2.1 Instant Processing: Payments made via Pay by Link are processed instantly upon authorization through secure payment checkout.

2.2 Supported Payment Methods: Available payment options (such as credit/debit cards, digital wallets, or local payment methods) are displayed on the checkout page and may vary by region or Merchant configuration.

2.3 Currency & Charges: Payments are processed in the currency indicated on the payment link. You are responsible for any foreign exchange conversion or transaction fees levied by your issuing bank or card provider.

2.4 Link Expiration: Payment links created via the platform are valid for a temporary duration set by the Merchant or platform security rules, after which they will automatically expire and can no longer accept payments.

3. Delivery & Fulfillment

3.1 Merchant Responsibility: Delivery timelines, shipping methods, digital distribution, and service performance schedules are established exclusively by the Merchant issuing the payment link.

3.2 Delivery Enquiries: For any questions regarding order status, shipment tracking, or delivery delays, please contact the Merchant directly using the contact details provided on your order receipt or invoice.

4. Refunds, Returns & Cancellations

4.1 Merchant Refund Policies: Requests for refunds, order cancellations, or returns must be directed to the Merchant. All returns and refunds are governed by the Merchant’s individual store policy and applicable consumer protection laws.

4.2 Processing Refunds: Approved refunds will be processed by the Merchant using nashi and our third-party processing infrastructure back to the original payment method used at checkout.

4.3 Disputes & Chargebacks: If you have an unresolved issue regarding a transaction, you should first seek resolution with the Merchant. If unresolved, disputes may be handled through your card issuer or payment provider’s formal dispute resolution process.

5. Privacy & Data Protection

5.1 Information Collected: When paying via a Pay by Link page, nashi and our payment processing partners collect necessary transaction data (such as payment details, billing address, IP address, and transaction metadata) to authorize the payment, enforce security, and prevent fraud.

5.2 Data Sharing with Third Parties:

  • Transaction data is shared securely with our authorized payment processing partners and card networks for payment authorization, risk management, and regulatory compliance.

  • Transaction confirmation details are shared with the Merchant to enable order fulfillment.

5.3 Cookies & Tracking: The payment checkout interface uses essential session cookies required for security, payment state maintenance, and fraud detection.

6. Limitation of Liability

6.1 Platform Disclaimer: To the maximum extent permitted by applicable law, nashi provides the Pay by Link technical service “as is”. nashi is not liable for:

  • The failure of any Merchant to deliver products or services as described.

  • Any direct, indirect, or consequential loss arising from the commercial transaction between the Shopper and the Merchant.

6.2 Third-Party Processing Interruptions: nashi is not liable for service interruptions or payment failures caused by third-party card networks, issuing banks, or underlying payment processing infrastructure.
